Yes, under certain circumstances a notary public may refuse to notarize a document. If the signer does not meet the notarization requirements because the signer and the notary public cannot understand each other, for example, or if the signer is confused or cannot definitively identify themselves, the notarization may then be denied. A notary public also cannot notarize a document in which he or she has any personal interest. Civil registry documents and any documents with missing or incomplete pages are also not eligible to be notarized. Notarization of illegal or inappropriate transactions should also be rejected.
• Do both parties have to be present to notarize a document?
No, people can have their documents notarized by notaries public at different times and even in different places. In these cases, each of the public notaries must record where the document was notarized, the type of notarial action, the name of the signer and the date.
• What do you need to bring to the notary public?
You will need to bring the document and the appropriate identification issued by your state.
• What identification is necessary for a notary public?
Identification presented to the notary public must be issued by the state or federal government, and must include your signature, photograph, and physical description.
